Terms & conditions

The general sales terms and conditions, hereafter referred to as the "terms and conditions," apply to all orders placed with Trinitus BVBA, domiciled at Hertshage 10 bus, 9300 Aalst – Belgium, hereafter referred to as "Komorebi Eyewear." These terms constitute the agreement binding the seller and the customer, hereafter collectively referred to as the "parties." The "customer" refers to any individual or legal entity that orders products from Komorebi Eyewear. The terms are freely available at all times on the Komorebi Eyewear website: www.mykomorebi.be. By placing an order, the customer declares to have read the terms and confirms acceptance of the resulting rights and obligations.

Invoices are payable in the currency stated on the invoice, at the seller's registered office, or via bank transfer and available digital options such as credit cards or PayPal, no later than 30 days after the invoice date, unless otherwise specified. Any dispute regarding an invoice must be sent via registered mail to the seller's registered office within 8 days of receipt of the invoice. Failure to do so renders the invoice indisputable. Payments made by the customer to Komorebi Eyewear are non-refundable.

In the event of late payment, a default interest rate of 5% per month will be charged on the outstanding balance automatically and without prior notice. Additionally, a fixed compensation fee of 10%, with a minimum of €75, will apply.

All potential disputes will be resolved, after failure of conciliation, by the competent courts of the judicial district of East Flanders.

Komorebi Eyewear aims to deliver orders no later than 6 months after the order date. If Komorebi Eyewear determines that this timeframe cannot be met, the customer will be informed no later than 14 days prior to the expected delivery date. The customer cannot invoke failure to meet delivery deadlines to claim compensation or termination of the agreement. Every delivery is sent via a certified courier and handed over to the customer upon receipt signature. Shipments are made under Incoterms DDU (Delivered Duty Unpaid).

In case of delays caused by force majeure or circumstances beyond the control of Komorebi Eyewear, the customer will be notified immediately. Such delays do not entitle the customer to cancel the order or claim compensation.

 

The customer is entitled to return individual unsold frames to Komorebi Eyewear within 1 year of the collection's purchase date. Komorebi Eyewear will accept these unsold frames on the condition that the customer places a new order of at least three times the number of returned frames. Returned frames will be credited on the new order and the accompanying invoice.

 

Komorebi Eyewear provides a 2-year warranty on manufacturing defects. This warranty does not cover damage caused by misuse, accidental damage, normal wear and tear, or modifications to the product. In the event of a manufacturing defect, the customer must contact Komorebi Eyewear and provide proof of purchase.

 

The customer may sell the received collection only at the sales location specified at the time of purchase. This sales location corresponds to the delivery address. The collection may not be sold online by the customer. Komorebi Eyewear retains the exclusive right to determine online sales of its collections.  

 

By placing an order and/or signing a purchase order, the customer agrees that digital material (photos, videos) may be created during the collaboration and used by Komorebi Eyewear for commercial purposes, including distribution on the website, Facebook, or Instagram. If individualized images of the client are created, they retain the right to review these images, oppose their use, and prevent their distribution for commercial purposes.

 

Information, logos, drawings, trademarks, models, slogans, corporate identity, etc., accessible via the seller's website or catalog, are protected by intellectual property rights. Unless expressly agreed otherwise, the customer is not permitted to modify, reproduce, rent, loan, sell, distribute, or create derivative works based on all or part of the elements displayed on the website or in the seller's catalog.  

 

Komorebi Eyewear is not liable for any indirect damages, consequential losses, or loss of profits resulting from the use of its products. The liability of Komorebi Eyewear is limited to the invoice amount of the product in question.

 

All agreements and disputes between Komorebi Eyewear and the customer are exclusively governed by Belgian law. Disputes will be handled by the competent courts of the judicial district of East Flanders.  

 

Komorebi Eyewear collects and processes customer data solely in accordance with the General Data Protection Regulation (GDPR). Data is used for order processing and customer communication.
